Authority to Restrict Travel: The Prevention Measure Under Indonesia’s New Criminal Procedure Code

Investigators, Public Prosecutors, and Judges Hold the Authority for Prevention against a Suspect or Defendant under Law No. 20 of 2025 concerning the Criminal Procedure Code (“New Criminal Procedure Code”).

The Prevention referred to is to impose a prohibition on a Suspect or Defendant from leaving the territory of the Unitary State of the Republic of Indonesia.

When implementing preventive measures, Investigators, Public Prosecutors, and Judges shall coordinate with and request the ministry responsible for government affairs in the field of immigration to prohibit the Suspect or Defendant from leaving the territory of the Unitary State of the Republic of Indonesia.

The prevention from leaving the territory of Indonesia, as referred to in paragraph (2), shall be imposed for a maximum period of 6 (six) months and may be extended once for a maximum period of 6 (six) months.

The technical implementation of the prevention as referred to above shall be carried out through mechanisms regulated in a Government Regulation.
